KAPTURO TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern access to and use of KAPTURO (“KAPTURO,” “we,” “our,” or “us”), including our website, mobile application, customer portals, communications tools, and related services. By accessing or using KAPTURO, you agree to these Terms.
ACCEPTANCE OF TERMS
By creating an account, accessing a customer portal, submitting information, or otherwise using KAPTURO, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use KAPTURO.
If you use KAPTURO on behalf of a business, you represent that you have authority to bind that business to these Terms.
DESCRIPTION OF KAPTURO SERVICES
KAPTURO provides business software and related tools that may include, without limitation:
- Customer relationship, lead, project, and scheduling management
- Estimates, proposals, documents, reports, and electronic signature workflows
- Customer portals and shared project communications
- Appointment confirmations, reminders, and service updates
- SMS, MMS, email, and other messaging features used by businesses operating on KAPTURO
SMS MESSAGING TERMS
If you provide a telephone number and consent to receive messages, you may receive SMS or MMS messages sent through KAPTURO or by businesses using KAPTURO. Messages may include appointment confirmations and reminders, estimate and proposal notifications, electronic signature requests, customer portal notifications, project and service updates, customer support communications, and follow-up messages related to an active inquiry, request, or business relationship.

- Message and data rates may apply.
- Reply STOP to opt out of SMS messages.
- Reply HELP for assistance.
- Consent to receive text messages is not a condition of purchase.
- We do not share, sell, rent, or provide mobile phone numbers or SMS consent to third parties or affiliates for marketing or promotional purposes.

USER RESPONSIBILITIES
When using KAPTURO, you agree to:
- Provide accurate information and keep account credentials secure
- Use the services only for lawful business purposes
- Comply with applicable laws, including messaging and privacy rules
- Obtain any required consents before sending communications through KAPTURO
- Not misuse, disrupt, reverse engineer, or attempt unauthorized access to the services
LIMITATION OF LIABILITY
To the maximum extent permitted by law, KAPTURO and its affiliates, officers, employees, and providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use KAPTURO.
To the maximum extent permitted by law, KAPTURO’s total liability for any claim arising out of or relating to these Terms or the services is limited to the amounts you paid to KAPTURO for the services giving rise to the claim during the twelve (12) months before the claim arose, or one hundred U.S. dollars (US $100) if no such fees were paid.
CHANGES TO THESE TERMS
We may update these Terms periodically. Changes will be posted on this page with an updated effective date. Continued use of KAPTURO after changes are posted constitutes acceptance of the updated Terms.
